Agreement to these terms
By using systara.co, submitting our diagnostic or intake form, or engaging Systara for services, you agree to these terms. Systara is the operational intelligence practice of TCS, a registered operating company that has traded since 2020. TCS is the contracting and billing entity on all engagements, and references to “Systara”, “we”, “us” or “our” mean TCS operating under the Systara name.
What we provide
Systara provides operational diagnostics, analysis and specification services, delivered primarily remotely. Every engagement states in writing which delivery model applies: specification-only, where we diagnose, design and specify and your own contractors implement, or managed execution, a separate scoped service where we also source and oversee implementation. Specific scope, fees, deliverables and timelines for any engagement are set out in a separate proposal or agreement, which takes precedence over this general page for that engagement.
Independence
We take no commission, margin, rebate or referral fee on equipment or installation, under either delivery model. Where you engage your own contractors on our specification, we don’t manage them and don’t carry the risk on their work; where we deliver managed execution, that is priced and scoped separately because it carries different risk.
No guarantee of results
Savings, payback periods and other figures we provide, including on this website, are estimates based on the information available at the time and, where marked, on our own case history. They are not a guarantee of results for your site. Actual outcomes depend on factors outside our control, including equipment condition, third-party installation quality, and how a recommendation is implemented. Where a figure is unverified or estimated, we say so.
Website use and content
The content on this site, including text, case studies and methodology descriptions, is provided for general information and belongs to Systara unless otherwise stated. You may view and share it for your own reference, but may not reproduce, republish or use it commercially without our permission. Case studies describe real engagements with identifying details removed; they are illustrative and not a promise of similar results.
Limitation of liability
This website and its general content are provided as-is, without warranties of any kind. To the fullest extent permitted by law, TCS and Systara are not liable for indirect, incidental or consequential loss arising from your use of this site. Nothing here limits liability that cannot be excluded by law, and nothing here overrides the specific terms, warranties or liability provisions in a signed engagement agreement, which govern that engagement.
Confidentiality and data
How we handle information you send us, including through our diagnostic and intake process, is set out in our Privacy Policy and our Data Commitment. Both are incorporated into these terms by reference.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they were last revised. Continued use of the site after an update means you accept the revised terms; changes do not apply retroactively to a signed engagement agreement already in place.
Governing law
These terms are governed by the laws of the jurisdiction in which TCS is registered. A specific engagement agreement may name a different governing law and forum for that engagement, in which case that agreement controls for its own scope.
